On 11th August 2023, the Ministry of Commerce (“MOC”) issued an Announcement No. 2652 on “Requirement on the Submission of the Affidavit of Use or Non-Use within one Year following the fifth (5th) anniversary of the date of registration or renewal” (“Announcement No. 2652”) to prevent the cancellation of their registration.

Announcement No. 2652:

Requirement on the submission of the Affidavit of Use or Non-Use within one Year following the fifth (5th) anniversary of the date of registration or renewal — to prevent the cancellation of their registration in accordance with Article 21 of the sub degree on the implementation of the law concerning marks, trade names and acts of unfair competition of the kingdom of Cambodia.

• Protection of the registered marks being canceled and removed from the list of registration.
• Changes: there is restriction on the prescribed deadline in which the registered trademark owner need to comply with.
• Requires affidavits of use or non-use strictly submitted by the specified deadline.
• Deadline: within one year following the fifth (5th) anniversary of the date of registration or renewal.
• Date of announcement: 11th August 2023.
